कर्मचारियों को बड़ी राहत|निलंबन हमेशा के लिए नहीं हो सकता: सुप्रीम कोर्ट

सुप्रीम कोर्ट ने कहा है कि सरकारी कर्मचारी का निलंबन अनिश्चितकाल के लिए नहीं हो सकता. यह एक सीमित अवधि के लिए संभव है. यह टिप्पणी करते हुए कोर्ट ने एक आईजी का छह साल पुराना निलंबन समाप्त कर दिया.

जस्टिस ए. एस. बोब्डे की पीठ ने अपने फैसले में कहा कि सरकार को लगता है कि आरोपी सबूतों से छेड़छाड़ कर सकता है तो उसे असंवेदशील पद पर रखा जा सकता है. तमिलनाडु के आईजी प्रमोदी कुमार पर एक वित्तीय कंपनी के निदेशकों से पैसे वसूलने का आरोप था. ये निदेशक निवेशकों के 1200 करोड़ गबन करने के मामले लिप्त थे. आईजी को गिरफ्तारी के बाद निलंबित कर दिया गया था.

कार्रवाई को चुनौती:

आईजी ने कैट में अपने खिलाफ कार्रवाई को चुनौती दी. कैट ने अनुशासनात्मक कार्यवाही में हस्तक्षेप से तो इनकार किया पर निलंबन रद्द कर दिया.. 

हाईकोर्ट में अपील:

अधिकारी ने मद्रास हाईकोर्ट में अपील की. हाईकोर्ट ने निलंबन के साथ आईजी के खिलाफ अनुशासनात्मक कार्यवाही भी निरस्त कर दी. अदालत ने कहा कि अधिकारी को दिए चार्जमेमो को अनुशासनात्मक अथॉरिटी की मंजूरी प्राप्त नहीं है. यदि इस अथॉरिटी के अलावा कोई और चार्जमेमो जारी करेगा तो आरोपी को संविधान के प्रावधान 311(2) की सुरक्षा से वंचित करना होगा. सरकार ने सुप्रीम कोर्ट में इसकी अपील की. सुप्रीम कोर्ट की पीठ ने कहा, नियम 8 यही कहता है कि चार्जमेमो अनुशासन समिति बनाएगी. इस नियम की अनदेखी नहीं की जा सकती.

कर्मचारियों को बड़ी राहत
  • फैसले से सरकारी कर्मचारियों को बड़ी राहत मिली है. इससे उन्हें अनिश्चितकाल तक निलंबन जैसा दंड नहीं झेलना पड़ेगा.पहले भी कोर्ट कह चुका है कि लंबा खिंचने वाला निलंबन एक कलंक है.
  • इससे पहले सुप्रीम कोर्ट ने व्यवस्था दी थी कि किसी भी सरकारी कर्मचारी को उसके खिलाफ आरोप पत्र के अभाव में 90 दिन से अधिक निलंबित नहीं रखा जा सकता. 
  • यदि यह अनिश्चितकाल के लिए हो या फिर इसका नवीनीकरण ठोस वजह पर आधारित नहीं हो तो यह दंडात्मक स्वरूप ले लेता है. 
  • यदि आरोपी अधिकारी या कर्मचारी को आरोप पत्र नहीं दिया जाता है और यदि आरोप पत्र दिया जाता है तो निलंबन की अवधि बढ़ाने के लिए विस्तृत आदेश दिया जाना चाहिए.

सेना में अधिकारियों के सात रैंक ही रहेंगे

सेना में अफसरों के करियर को आकर्षक बनाने के लिए जल्द ही अहम बदलाव हो सकते हैं. नए प्रस्ताव के तहत अफसर मेजर के बाद सीधे कर्नल बनेंगे और कर्नल के बाद मेजर जनरल पद पर तैनाती मिलेगी. मेजर के बाद लेफ्टिनेंट कर्नल और कर्नल के बाद ब्रिगेडियर के मौजूदा पद खत्म हो सकते हैं.

लंबे समय से चल रही थी रैंकों में बदलाव की मांग 

सेना से जुड़े सूत्रों ने कहा कि रैंक में बदलाव को लेकर लेफ्टिनेंट जनरल स्तर के अधिकारियों के अधीन चार विशेषज्ञ समितियां गठित की गई हैं. जो नवंबर के अंत तक रिपोर्ट सौंपेंगी. इन समितियों में विचार-विमर्श की प्रक्रिया अंतिम चरण में है. पदों के नए स्वरूप का खाका लगभग तैयार हो चुका है.


सेना में अधिकारियों के सात रैंक ही रहेंगे

सेना में अफसरों की एंट्री से लेकर शीर्ष तक पहले दस पद होते थे. रक्षा अकादमी से निकलने के बाद सेकेंड लेफ्टिनेंट के रूप में भर्ती होती थी. उसके बाद लेफ्टिनेंट, कैप्टन, मेजर, ले.कर्नल, कर्नल, ब्रिगेडियर, मेजर जनरल, ले. जनरल तथा उसके बाद जनरल का पद होता है. लेकिन सेकेंड लेफ्टिनेंट का रैंक पहले ही खत्म किया जा चुका है. अब सीधे लेफ्टिनेंट के रैंक पर भर्ती होती है. नए प्रस्ताव के तहत मेजर के बाद सीधे कर्नल बनेंगे। कर्नल के बाद मेजर जनरल। सिर्फ सात रैंक ही रह जाएंगे.

नौसेना एवं वायुसेना की स्थिति

नौसेना एवं वायुसेना में अफसरों के रैंक कम होने की वजह से बेहतर स्थिति है. नौसेना में कर्नल के रैंक का पद कैप्टन और वायुसेना में ग्रुप कैप्टन होता है. कैप्टन एवं ग्रुप कैप्टन बनने वाले कुछ सालों के बाद कमोडोर और एयर कमोडर पद पर पहुंच जाते हैं. लेकिन कर्नल के लिए ब्रिगेडियर बनने की राह कठिन होती है, क्योंकि 10 कर्नल में से महज तीन को ही आगे प्रोन्नति मिल पाती है.

  • सेना में लेफ्टिनेंट के रूप में करियर शुरू करने वाले ज्यादातर अधिकारी नई व्यवस्था में मेजर जनरल रैंक तक पहुंच सकेंगे.
  • रैंकों में बदलाव से सेना परोक्ष रूप से अधिकारियों की क्षमता में इजाफा कर अपने खर्च में कमी लाना चाहती है.
  • तीसरा रक्षा मंत्रालय का मानना है कि इससे सेना में अफसर बनने के लिए नौजवानों में आकर्षण बढ़ेगा.

कर्नल तक पहुंचने के बाद ज्यादातर सैन्य अधिकारियों के करियर को ब्रेक लग जाता है. केंद्र सरकार के कार्मिकों से तुलना करें तो कर्नल का पद निदेशक स्तर का होता है. केंद्रीय सेवाओं में भर्ती होने वाले ज्यादातर अफसर संयुक्त सचिव या इसके ऊपर के पदों तक पहुंचते हैं. लंबे समय से रैंकों में बदलाव की मांग चल रही थी.

सीएसएस केंद्रीय स्तर पर प्रशासनिक कामकाज के लिए अहम सेवा है. इसमें विभिन्न स्तरों पर करीब 12 हजार पद हैं. प्रोन्नति में विलंब और नई भर्तियां न होने से कई पद खाली हैं. एसओ, अंडर सेक्रेटरी और डिप्टी सेक्रेटरी के करीब ढाई हजार पद रिक्त हैं. सीएसएस को प्रोन्नति के लिए पात्र होने के बावजूद नान फंक्शनल बेनीफिट नहीं दिया जाता. जबकि आईएएस सहित 49 सेवाओं को यह लाभ दिया जाता है. सीएसएस को संगठित सेवा के रूप में मान्यता देने की मांग भी सरकार ने स्वीकार नहीं की है.

केंद्रीय सचिवालय सेवा में प्रोन्नति के लिए नियमों में बदलाव का डीओपीटी का प्रस्ताव कैबिनेट सचिव ने खारिज कर दिया है. कैबिनेट सचिव ने सीएसएस रूल 1962 के पुराने नियम के तहत ही प्रोन्नति प्रक्रिया पूरी करने को कहा है. पेच के चलते सीएसएस के कुल अनुमोदित पदों में से करीब 40 फीसदी पद खाली है.


डीओपीटी ने बदलाव का प्रस्ताव दिया था

सचिवालय सेवा के अफसरों की प्रोन्नति 1962 के सीएसएस रूल के तहत होता था. इसके तहत इन्हें अप्रूव्ड सर्विस के दायरे में रखते हुए अनुमोदन के बाद रिक्त पद के वर्ष से प्रोन्नति के लिए पदों की गणना होती थी. लेकिन डीओपीटी ने नियमों में बदलाव का प्रस्ताव करते हुए सीएसएस सेवा को नियमित सेवा के दायरे में लाने का फैसला किया था. इसकी वजह से रिक्तियों के बजाए जिस तिथि से नियमित नियुक्ति होती है, उसकी गणना करके प्रोन्नति देने का प्रस्ताव था.


नुकसान की आशंका

इस संबंध में सीएसएस के संगठन ने कैबिनेट सचिव से मुलाकात की थी. संगठन का कहना था कि लंबित प्रोन्नति प्रक्रिया नियमों में बदलाव से और भी ज्यादा बाधित होगी. इसका बड़ा नुकसान होगा कि विभिन्न पदों पर प्रोन्नति के लिए पात्र लोगों की संख्या में कमी आएगी. सीएसएस का तर्क है कि इससे कामकाज भी प्रभावित होगा, क्योंकि विभिन्न जरूरी पदों पर बड़ी संख्या में पद रिक्त हैं.

THE RAILWAYS has stopped an employment initiative launched in 2004, when it started giving jobs to children of employees in the lower tier. 

The Liberalised Active Retirement Scheme for Guaranteed Employment for Safety Staff (LARSGESS), which was started during former railway minister Nitish Kumar’s term in 2004, was suspended indefinitely last month following an order from the Rail Ministry. The order issued to all zonal railways stated: “Keep LARSGESS on hold till further orders.”
